The EU revises (EU) No 10/2011 on food contact plastics
On September 3, 2020, the European Union published Regulation (EU) No 2020/1245 to amend and correct Regulation (EU) 10/2011 on food contact plastics. This regulation contains, inter alia, important changes to Annexes I, II, IV, and V to the Regulation (EU) No 10/2011. The highlights of the updates in this new regulation are changes to specific migration, provisions on migration tests and plastic materials or articles for repeated use and the update on overall migration conditions. Regulation (EU) No 2020/1245 enter into force on September 23, 2020, and food contact plastics complying with the old regulation before the entry into force of the new regulation, and which were first placed on the market before March 23, 2021 may continue to be placed on the market until September 23, 2022 and remain on the market until the exhaustion of stocks.

The EU revises Regulation (EU) 2019/1021 on POPs
On August 18, 2020, the EU published amendments (EU) 2020/1203 and (EU) 2020/1204 in its Official Journal to revise requirements of regulated substances and related provisions in POPs Recast Regulation (EU) 2019/1021. Regulation (EU) 2020/1203 revises provisions of exemption for perfluorooctane sulfonic acid (PFOS) and its derivatives in Annex I to POPs regulation; Regulation (EU) 2020/1204 adds dicofol (CAS No 115-32-2) to Part A of Annex I to POPs regulation. The amendments above enter into force on the twentieth day following its publication in the Official Journal of the European Union. In addition, the EU has issued several draft amendments to POPs regulation and launched public consultation related to PFOA, its salts and PFOA-related compounds and pentachlorophenol (PCP) and its salts and esters. The consultation period is from September 1, 2020 to September 29, 2020.

ECHA published the 24th batch SVHC consultation list
The European Chemicals Agency (ECHA) has published the 24th SVHC consultation list on September 1, 2020. Two substances are subjected to public consultation in the list including bis(2-(2-methoxyethoxy) ethyl) ether, and dioctyltin dilaurate, stannane, dioctyl-, bis(coco acyloxy) derivs., and any other stannane, dioctyl-, bis(fatty acyloxy) derivs. wherein C12 is the predominant carbon number of the fatty acyloxy moiety. The deadline for consultation is October 16, 2020, before when comments can be submitted by interested parties to ECHA. The substances whose proposals are adopted will be included in the 24th SVHC candidate list. SGS suggests enterprises to review relevant substances in products to respond to regulatory changes.

The EU proposes to revise restriction requirements of PAHs in Annex XVII of REACH regulation
On September 8, 2020, the EU submitted notification G/TBT/N/EU/736 to the WTO proposing to revise the Entry 50 in Annex XVII of REACH regulation ((EC) No 1907/2006) on restriction requirements of PAHs, and launched public consultation. The draft regulation proposes to extend the restriction requirements of the 8 PAHs to granules or mulches used as infill material in synthetic turf pitches or in loose form on playgrounds or in sport applications, and the total concentration must not exceed 20 ppm. The draft regulation also interprets the relevant definitions. The public consultation ends on November 7, 2020, and it is expected to be adopted in the the first quarter of 2021. The relevant restriction provisions will become effective 12 months after the regulation comes into force.

The UK published guidance on placing goods on the market after Brexit
On September 1, 2020, the UK published ‘Guidance on placing manufactured goods on the market in Great Britain from 1 January 2021’ and this guidance is about placing manufactured goods on the market in Great Britain (GB) after the transition period of Brexit. Great Britain includes England, Wales and Scotland. According to the guidance document, from January 1, 2021, the UKCA (UK Conformity Assessed) marking will be the conformity assessment marking for Great Britain, however, the CE marking could still be used until January 1, 2022 in most cases, and the CE marked goods that meet EU requirements can only be placed on the market in Great Britain while UK and EU requirements are the same. However, for goods that meet specific situations, the UKCA marking is required from January 1, 2021.
