Why

Why comply with Proposition 65?

• Proposition 65 is a right-to-know law, advocating that people have the right to be informed when exposed to toxic substances. Any stakeholder can sue manufacturers for non-compliance.
• If a product contains listed substances and exposes California residents beyond the safe harbor level, warning labels are required; failure to do so violates Proposition 65.
• In lawsuits, the manufacturer must provide reasons and evidence if warnings are not labeled. Violations can result in penalties up to $2,500 per day, and manufacturers may be required to stop selling non-compliant products, instruct retailers to cease sales, recall products, or provide proper warnings.
