There are a total of 32 items. Items No. 1 to No. 18 are more commonly found in electrical and electronic products, while items No. 19 to No. 32 may be present in natural crops.

Who

Who needs to comply with EU POPs?

EU POPs is a mandatory regulation enacted by EU legislation. All products placed on the EU market must comply with the POPs regulation. The product definition is the same as REACH, but the scope of restriction is even broader than RoHS and REACH. In addition to prohibiting the import, production, and manufacturing of hazardous substances containing POPs, even waste containing POPs from the manufacturing process must not be discharged into the environment.

Product definitions are as follows:
  • Substance
    1. Refers to a chemical element or compound obtained naturally or through artificial synthesis.
    2. Examples: CH4 (Methane), Sulfuric Acid, Ethyl Alcohol
  • Mixture
    1. Refers to a mixture or solution containing two or more substances.
    2. Examples: Paint, Ink, Plastic Resin
  • Article
    1. A product composed of substances or mixtures which, due to functional requirements, is designed or manufactured with a specific appearance or shape.
    2. Examples: Screw, Heat Shrink Tube, O-ring

Friendly Reminder: Most products on the market are "complex articles," such as: PCBs (Circuit boards), Monitors, Servers, Medical devices, etc. To comply with POPs regulations, complex articles must first be disassembled into individual "Articles."

Why

Why comply with EU POPs?

  • The RoHS Directive, REACH Regulation, and POPs Regulation are all mandatory requirements for exports to Europe. All three adopt similar regulatory mechanisms with the common goal of protecting human health and the environment.
  • Manufacturers entering the EU market should understand their roles and responsibilities within the POPs framework and ensure products meet POPs compliance requirements to circulate smoothly in the EU market.
  • Ensuring compliance with POPs protects manufacturers from penalties and fines. If non-compliance is discovered by authorities or reported during market circulation, penalties, fines, and product recalls or destruction may occur.

When

When did EU POPs take effect?

  • May 20, 2004: Officially effective as Regulation (EC) No 850/2004
  • July 15, 2019: Officially effective as Regulation (EU) 2019/1021 (repealing (EC) No 850/2004)
